Terms of Service

These Terms of Service govern your interaction with CarCreature.AI ("CarCreature," "we," "us"), including text messages ("SMS") sent as part of a product demonstration, sales conversation, or a dealership's use of our software (including Torq and Octo).

SMS messaging program

As part of our Octo product, a dealership using our software may send you a single text message on their behalf, containing a link to review vehicle protection product options ahead of an in-person appointment. Octo is an optional customer-convenience feature — it is never required to purchase a vehicle, obtain financing, or complete any part of a transaction. A typical message reads:

"[Auto Dealer Name]: Hi [Maria], I'm Octo, your F&I assistant. Before your appointment, take 3 minutes to review your protection options: [link]. Reply STOP to opt out."

By providing your mobile number to a dealership and affirmatively consenting via the standalone opt-in checkbox described below, you agree to receive this message.
Message frequency is limited to your specific transaction (typically 1–2 messages) — we do not send recurring marketing messages through this program.
Message and data rates may apply, depending on your mobile carrier plan.
Reply STOP at any time to opt out. Reply HELP for assistance, or contact support@carcreature.ai.
Carriers are not liable for delayed or undelivered messages.

Dealer opt-in requirement

Dealerships are contractually required to obtain proper customer consent before enabling Octo's SMS messaging feature. Specifically, a dealer's buyer's order or credit application must include a standalone, clearly labeled consent checkbox — unchecked by default and separate from all required purchase, financing, and credit application fields — using language substantially similar to the following:

"Communication Consent and Privacy Policy. By checking this box, I confirm that I had the opportunity to review [Dealer] Privacy Policy and I agree to receive text messages, phone calls, and emails at the contact information I provided, related to my visit, inquiry, or transaction. I understand that my consent is not required for purchase. Message and data rates may apply, and I can reply “STOP” at any time to opt out."

Checking this box must never be a condition of completing a vehicle purchase, credit application, or any other transaction.
A customer who declines this checkbox may still purchase a vehicle and complete financing in full.
Only customers who affirmatively check this box may be sent a text message through Octo.
Dealers who have not implemented this opt-in flow are not permitted to enable Octo's SMS messaging feature.

Acceptable use

Our products and messaging services are intended for use by dealership personnel, their customers, and prospective business customers evaluating our software. You agree not to misuse the service, including by attempting to interfere with its operation or using it to send unsolicited messages to others.

No warranty

Our products, including any AI-generated content or recommendations, are provided "as is." Product and pricing information (such as protection plan payment estimates) is provided for informational purposes and is subject to confirmation by the dealership at the time of purchase.

Limitation of liability

To the extent permitted by law, CarCreature is not liable for indirect, incidental, or consequential damages arising from use of our products or messaging services.

Changes

We may update these terms from time to time. Continued use of our products or messaging services after a change constitutes acceptance of the updated terms.
